FCA US Privacy Notice


FCA US LLC ("FCA US,” “we,” “our,” or “us”), often known by our brands Jeep, Dodge, Ram, Alfa Romeo, Chrysler, and Fiat, provides vehicles, websites, mobile applications, and other products and services, such as connected vehicle services. This Notice explains how we collect, use, share, and protect personal data across our brands when you interact with us, purchase or lease a vehicle, visit our websites, use our apps, engage with customer support, or otherwise use our products and services. It also covers rights and choices related to your personal data. 

 

This Notice does not apply to:

1. Employees, applicants, retirees, independent contractors, and other workers. They receive separate notices from us.

2. FCA dealers. See FCA dealers’ websites for their privacy notices.

3. Financial services. See the Stellantis Financial Services privacy notice for more information.

4. Third party services. See third party privacy notices when services may relate to your vehicle or data from your vehicle, but are not provided by us, as further described in this notice.

 

 

Data We Collect and How We Use It

We collect data about you in different ways. For example, we collect data:

Directly from you. This includes when you make an account, sign up to get our emails, buy from us, or contact us.

Automatically. This includes cookies, server logs, and other tools on our website or apps.

From other sources. These can include our affiliates, dealers, vendors, social media partners, publicly available sources, and other companies.

 

When You Interact with Us Through our Channels or Products

The following are examples of our collection and use of your data when you, for example, visit our website or contact our customer service representatives:

Compliance Hotline We have a third party that runs a whistleblower hotline. We collect the personal data that individuals who use that hotline provide. This may include their contact information and information that relates to other individuals or employees.    We may use this data to understand issues that might violate our policies or procedures. In some situations, we may need to disclose the information that someone provides to us. When that occurs, the disclosure might be based on consent, our compliance with laws mandating disclosure, our legitimate business interest in running our business, or protecting someone. The information that you submit may also be governed by the privacy notice of the company that we use to operate our compliance hotline. 
Email Interactions If you receive an email from us, we use tools to capture when you open our message, click on links or banners in it, or make purchases after receiving an email.  We use this data to understand how you engage with our messages.
Feedback/Support  If you provide feedback or contact us for support, we may collect your name and email, as well as other content that you send.  We may use this data to receive and act upon feedback. 
Fraudulent or Illegal Activity  We may collect data described in this notice such as purchase and payment information and account registration information to prevent fraudulent and illegal activity.   We may use this data to detect and prevent against malicious, deceptive, fraudulent, or illegal activity. 
Mobile Devices

We may collect information your device broadcasts when you visit our website.

 

If you download one of our apps, we may also collect your location from the GPS, Wi-Fi, and/or cellular technology in your device.

In addition to providing mobile app features, and services, we may use mobile app data to identify unique visitors and understand how users engage with us. We may also use location information to provide tailored services. In some contexts, our use may also be based upon your consent to share precise location data. 
Newsletter  When you sign up for our newsletter, we may collect your contact information.  We may use this data to share information about our products and services. 
Partner Promotion We may collect data that you provide as part of co-branded promotions with other companies. 

We may use this data to fulfill our promotions. Note that many co-branded promotions involve the collection of information by us, and another company identified in the promotion. Where data is jointly collected, your information may be submitted, or sent, to both companies. This privacy notice applies to our use of your data. 

You should review the privacy notice of the other companies identified to understand their use of your data. 

Purchases and Payments   We may collect your name, billing, shipping, and email address, phone number, and credit or debit card information when you purchase products or services from us such as branded merchandise or parts. 

We may use your data to perform our contract to provide products or services. We may also keep the data for our records and to recommend future products. 

SMS (text) Marketing  We may collect your phone number to send you marketing messages. 

With necessary consent, we may use your phone number to send marketing texts. While we may provide your number to our dealers for them to contact you about products or services, we will not sell your phone number with other third parties for them to send marketing about products unrelated to us unless you have consented to that sharing.

Surveys We may collect data you share through surveys.  

We may use this data to understand your opinions. If a survey is offered by a third party, the third party’s privacy notice also applies to the collection, use, and disclosure of your data.

Sweepstakes or Contests  When you enter a sweepstakes or contest, we may collect data about you such as your contact information.  We may use this data to operate the sweepstakes. We may also be required by law to collect such data. If a sweepstakes or contest is offered by a third party, the third party’s privacy notice may also apply to the collection, use, and disclosure of your data. 
Use of Our Website  We may use technology (e.g., a cookie or a pixel) to learn how you engage with our websites. This may include which links you click or what you type into our online forms. We may also track your IP address, the website that referred you to us, and data about your device.   We may use this data to make our website operate. We may also use it to understand how you interact with our websites, gather analytics, improve our websites, and learn your preferences. We may also use this data to help detect and prevent fraud, debug, find, and fix errors that impair our website and services and find and prevent security incidents. 
Blogs and Posts If you choose to engage in forums, blogs, or other similar features offered by us, we may maintain records about the content you post. This might include comments, reviews, or questions as well as metadata associated with your content.  We may use this data to understand your opinions and foster a safe environment on our websites. 
Website Targeted Advertising Technology  We may allow third parties to place tracking technology on our websites (e.g., a cookie or a pixel). The third party may also collect data over time and across other websites. Among other things, they may use this data to serve ads tailored to your interests, which may include ads about our products or services.   Please visit the Cookie Settings link in the footer of the website you are visiting for more information. When You Purchase or Lease a Vehicle

In addition to the data we collect through our interactions described above, we may collect information when you purchase or lease a vehicle. The following are examples of our collection and use of your data when you purchase or lease a vehicle from a dealership:

Note about Fleet Vehicles - When we sell multiple vehicles to an organization we may collect business contact information of the purchaser. We may also collect data about individual vehicles such as VIN and location. Fleet owners are responsible for providing a privacy notice to the people driving vehicles they purchase. They are also responsible for obtaining consent, if necessary, from drivers. 

 

To Provide Products and Services

In addition to the data we collect through our interactions and when you purchase or lease a vehicle, we may collect the following types of data to provide products and services:

Connected Vehicle Services

We may obtain data from in vehicle systems, sensors, software, and equipment, and vehicle-related mobile applications depending on what Connected Services are enabled. The information may include:

 

• Vehicle location (precise latitude and longitude),

• Driving data (such as when and how the car is used– e.g., speed, braking, steering, seat belts), or

• Vehicle data (such as mileage, odometer, emissions data, error codes, diagnostics, or service history).

 

We may also obtain information from third parties when the car is integrated with services such as Amazon Alexa®. 

We use this data to provide Connected Service features such as:

 

• Remote Start,

• Vehicle Locate,

• Roadside Assistance,

• Navigation, Entertainment and Voice Commands,

• In-Vehicle or App Alerts,

• Vehicle Health or Maintenance Reports, or

• Wallet Services.  

Vehicle Analytics We may obtain data about the usage of vehicle features, apps, services, and technology (such as what features are used).

We may use this data to:

 

• Improve or develop products and services, and

• Personalize the content that we display to you, including providing more relevant advertisements. 

 

Third-Party Data Sharing with Your Consent We may collect telematics, such as the Connected Vehicle Services data described above that concern your vehicle and driving patterns. 

We may share telematics with a third party, such as an insurance company, with your consent.

 

Consent may either be in the form of an instruction given by you to us or an instruction that you give to a third party (such as an insurance company) to obtain information from us. 

 

The sections above describe our main purposes in collecting your data, but often we have multiple purposes. 

 

To the extent we store and use deidentified personal data, we will not try to reidentify the information, except to test our deidentification methods. We may process deidentified data for a valid business purpose. 


How We Share Data

In addition to the specific situations discussed elsewhere in this Notice we may share personal data in the following situations:  

 

• Affiliates and Acquisitions. We may share data with our affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control) for the purposes described in this Privacy Notice. If a company acquires or enters negotiations to acquire our company, business, or assets, we may share data with that company.

 

• Other Disclosures Without Your Consent. We may share data to cooperate with law enforcement, participate in a legal process, or for legal compliance. We may share your data to establish or exercise our rights, to defend against legal claims, to investigate, prevent, or act on possible illegal activities, threats to safety of person or property, or a violation of our policies. Your data may be shared to ship products to you.

 

• Service Providers. We share your data with service providers for purposes of running our business, such as by supporting our websites, conducting surveys, providing technical support, providing products and services, processing payments, fulfilling orders, and more.

 

• Third Party. Some offerings that are available in connection with our products and services (including our Connected Services) are offered by third parties (for example, roadside assistance, SiriusXM, navigation and traffic services, and emergency services/providers and responders). When you use these third-party offerings, the third party may collect or receive your personal data and use it for its own purposes. The third party’s privacy notice—not this Notice—governs its collection, use, and disclosure of your personal data.

 

• Dealers. We may share personal data with dealers for business purposes, such as to allow us and the dealers to better respond to your requests and send you relevant and personalized offers and information.

 

• Other Drivers. If you are an owner and you permit another driver to register your vehicle for a Connected Service or to otherwise access and use your Connected Services, including the Wi-Fi® Hotspot Service, then such individuals may have access to your accounts and associated personal data and may be able to disclose or submit requests related to the Connected Services, including the Wi-Fi® Hotspot Service.

 

• Professional Services. We may share personal data with professionals that provide us with services, such as auditors or lawyers.

 

• Other Disclosures with Your Consent. We may share your data with third parties when you consent or direct us to, such as when you authorize us to share your data with third parties, such as insurance carriers, for insurance offers.  

 

Some jurisdictions require us to disclose whether the following categories of personal data are collected, shared with third parties for a “business purpose,” “sold,” or transferred for “valuable consideration.” The table below indicates the categories of personal data we collect and transfer in a variety of contexts. Your Choices

Some jurisdictions give you the right to make the following choices: 

 

• Access. You may request access to your personal data or confirmation that we have data about you. In certain limited cases, you may ask to receive access to your data in a portable, machine-readable form.

 

• List of Third-Party Recipients. You may request a list of specific third parties to whom we have disclosed personal data. Some jurisdictions also allow you to obtain a list of the categories of third parties to which we have disclosed personal data. You can find that information in the table above under the “How We Share Data” section.

 

• Change. Most of our websites allow you to change your account profile. If our website does not permit you to update or correct certain information, you can ask us to correct inaccurate or incomplete data by contacting us at the address below. We may keep historical data in our backup files as permitted by law.

 

• Deletion. You may ask us to delete your personal data. If required by law, we will grant such a request, but in many cases we must keep your personal data to comply with legal obligations, resolve disputes, enforce agreements, or for other business purposes.

 

• Opt-out of Targeted Advertising. You may opt-out of online tracking based targeted advertising (e.g., cookies) by clicking the “Cookie Settings” link on the homepage. Note that if you change browsers or devices, or if you clear your browser’s cache, you may need to click the link again to apply your preference. We recognize Global Privacy Control (GPC) signals broadcast from web browsers as a valid opt-out request where required by applicable law. Please note that the GPC will be applied only to your current browser. We do not recognize the “Do Not Track” signal.

 

• Promotional Emails. You may provide us with your email address to allow us to send newsletters, surveys, offers, or other promotional content, as well as targeted offers from third parties. You can stop receiving such emails by following the unsubscribe instructions at the bottom of those emails or by making a request through our online privacy portal. If you choose not to receive such emails, we may still send you service-related communications.

 

• Promotional Mailings. If you do not want to receive offers and/or circulars from us, email us with “NO SNAIL MAIL” in the subject line, and include your name, address, and zip code. Note that our mailings are prepared in advance of being sent. We will remove your name from our mailing list after receiving your request, but you may receive mailings from us that had been initiated prior to processing your request. 

 

• Promotional Text Messages. If you get a text message from us that has promotional content, you can opt-out of future text messages by replying “STOP.”

 

• Revocation Of Consent. Where we process your personal data based upon consent, you may revoke consent. Note, if you revoke consent for processing personal data, we may no longer be able to provide you with some types of services.

 

• Disabling Certain Services. You may opt out of certain features and services, such as Vehicle Health Reports, and notifications, by disabling them through your Connected Services account.

 

• Geolocation Data. You can turn off geolocation data for mobile apps through your mobile device’s privacy settings. In addition, certain vehicles may enable you to turn on/off sharing of geolocation for certain features. Note that turning off geolocation will not stop the use of your vehicle’s geolocation data entirely. Certain Connected Services that require geolocation data to function, such as the Wi-Fi® Hotspot Service, emergency and roadside services, vehicle finder, and navigation may continue to access and receive geolocation information. You can turn off all transmission of personal data by your vehicle by deactivating Connected Services, including the Wi-Fi® Hotspot Service.

 

• Deactivate Connected Services and Stop Collection of Personal Data. Expiration or termination of your Connected Services subscription does not automatically stop all collection of personal data from your vehicle. If you want to stop remote transmission and collection of personal data from your vehicle, you must contact us as follows and request to “CANCEL FOR PRIVACY REASONS:” 

o SiriusXM Guardian Subscribers: call 844-796-4827 (toll free) and request to cancel for privacy reasons.

o Vehicle Connect Subscribers (including Jeep® Connect, Ram® Connect, Wagoneer® Connect, Alfa® Connect, Chrysler® Connect, and Dodge® Connect): call 800-777-3600 and request to cancel for privacy reasons. 

 

Not all the rights above are absolute, and they do not apply in all circumstances. We may limit or deny a request because the law permits or requires us to. We will not discriminate against individuals who exercise a privacy right.

 

Submitting Requests

 

Unless an alternative process was described above, you may exercise the above rights through our online portal or by contacting us via the contact information below. If you disagree with our denial of a request, you may appeal our decision by contacting us with the subject line “Appeal.”

 

We will require you to prove your identity when making most types of requests. We may verify your identity by phone or email. Depending on your request, we will ask for information such as your name, the last item you purchased from us, or the date of your last purchase from us. We may also ask you to send us a signed declaration confirming your identity.

 

In some circumstances, you may designate an authorized agent to exercise rights on your behalf. If you are an authorized agent, you must attach a copy of a completed Authorized Agent Designation Form which shows that you may act on another’s behalf. You can find the Authorized Agent Designation Form on our online portal.


How We Protect and Retain Data

No method of internet transmission or electronic storage is fully secure. While we use reasonable efforts to protect personal data, we cannot guarantee its security. If we are required to inform you about a security incident, we will do so electronically, in writing, or by phone, as the law permits.

 

Some of our websites permit you to create an account. You are responsible for selecting a unique and complex password and keeping it confidential. You are responsible for any access to or use of your account by someone who has obtained your password, whether or not you approved of such access or use. Notify us of unauthorized use of your password or account immediately.

 

We keep your personal data for only as long as necessary to fulfil the purposes in this Notice unless a longer retention period is required or permitted by law. For example, we may need to further retain your personal data for purposes of satisfying legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the data. We also weigh the potential risk of harm from unauthorized use or disclosure of the data, the purposes for which we obtained the data, and whether we can meet those purposes through other means, as well as applicable legal requirements.


Third-Party Applications/Websites

We may provide links to websites and other third-party content or services that we do not own or operate. We have no control over the privacy practices of websites or services we do not own. For details about such third parties’ privacy practices, see their privacy notices. 


Special Notice to International Users and Customers

As a globally operating company, FCA US may transfer your personal information to the United States and to other jurisdictions where we or our affiliates, suppliers, or service providers have operations. As such, your personal information may be accessed, stored, processed, or subject to law enforcement requests in these jurisdictions, which may not have equivalent privacy laws as in your home jurisdiction. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it, including through appropriate written data processing terms and/or data transfer agreements.

 

FCA US complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. FCA has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. FCA has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss U.S. DPF Principles, the Principles shall govern. Changes to this Privacy Notice

We may change our Notice and privacy practices. New notices will be published on our website. If changes are material, the Notice that was in place when you submitted personal data to us will generally govern that data unless you consent to the new Notice. Our Notice shows “effective” and “last updated” dates below. The effective date is the date the current version took effect. The last updated date is the date the current version was last substantively changed.

Additional Information for California Residents

California law requires us to disclose the following information on our privacy practices. If you are a California resident, the following disclosures apply to you in addition to the rest of the Notice. 

 

• California Shine the Light. If you would like more information on the categories of personal data (if any) we share with third parties or affiliates for those parties to use for direct marketing, make a request through our online privacy portal.

 

• California Notice of Financial Incentive. We may offer programs that give perks, like rewards, discounts, and exclusive offers (“Loyalty Programs”). When you sign up for a Loyalty Program, we ask for your name, email address, and in some cases your phone number. Under California law, our Loyalty Programs might be considered “financial incentive” programs as they involve collecting personal data. We do not assign a monetary value to the data we collect. Based on our reasonable estimate, the value of your personal data to us is related to the value of the free or discounted products or services you get when you redeem points. This value is based on the cost related to offering those free or discounted products or services. You may withdraw from the Loyalty Programs by contacting us at the address described in the program terms and conditions. You will be given a link to the Loyalty Program terms when you sign up. 

 

• California Sensitive Information Disclosure. We collect the following categories of sensitive personal data (as defined under California law): precise geolocation, biometric information, driver’s license, government identifiers, and username and password. This data is collected to process transactions, comply with laws, manage our business, or provide services. Note that we do not use such data for any purposes that are not identified within the California Privacy Rights Act Section 1798.121. We do not “sell” or “share” sensitive personal data for cross-context behavioral advertising, although we may transfer it to third parties when you instruct us to do so. When that occurs, third parties will use it for the purposes indicated in their privacy notices.
